Law enforcement in Northeast and nearby Denton County communities are keeping a close watch over traffic to ensure that all drivers, Class C and CDL alike, aer abiding by Texas traffic law. Perhaps you have been caught speeding, running a red light or stop sign, failing to yield right of way or committing another ticketable traffic offense. If so, and if you have been issued a traffic ticket as a penalty, you have a decision to make. You must decide whether to plead guilty to your violation, and allow points to be added to your driving record, or to challenge your offense in an effort to protect your record. At the Law Office of Attorney Jack Byno, we have been helping drivers just like you challenge traffic violations issued to them in Northeast for more than 20 years. We understand that a clean driving record is important, especially if you hold a CDL, and therefore may be able to seek you a favorable plea deal, such as reduced fines, driving safety courses or deferred adjudication, in lieu of points added to your driving record. If you are interested in fighting your violation, we may also be retained to represent you before a judge at trial. For additional information, please fill out our Traffic Ticket Contact Form.
Speeding tickets are written to drivers every day in Northeast. Even though the speeding violation is common, it should not be taken lightly and must be responded to in a timely manner just like any other traffic violation. If you believe that it would be in your better interest to challenge your speeding ticket instead of plead guilty to it, it is your right as a licensed Texas driver to do so. You may attempt to dispute your Northeast violation on your own, or with help from a speeding ticket attorney. Because Jack Byno & Associates have been challenging speeding tickets in towns all across the DFW metroplex since our founding in 1994, rest assured that, if hired to defend against your violation, our attorneys will do their best to ensure that your driving record is successfully protected from points.
On occasion, the Northeast Municipal Court is prompted to issue arrest warrants for drivers with outstanding traffic tickets. No matter why you were issued your violation, and no matter what class driver's license you hold, once a traffic citation is handed to you, it becomes your responsibility to respond to it in a timely manner, either by pleading guilty to it or by taking appropriate legal measures to challenge it. If you simply allow your ticket to go past due, you can expect for the Northeast Municipal Court to issue a warrant for your arrest as a penalty. Once an arrest warrant is out for you, you could be arrested at any time, perhaps even during the Great Texas Warrant Roundup (an annual event that sees law enforcement arresting as many drivers as possible who have previously been issued traffic warrants by the court). Fortunately, there may be a way for you to avoid arrest once a traffic warrant has been issued for you. Jack Byno & Associates may be able to post bond for you and get your traffic warrant lifted, so that you may avoid arrest, even during Warrant Roundup season, and so that your case may be represented in court at a later date.
Perhaps you drive with a commercial driver's license (CDL), and rely on it for work as a trucker, school bus driver, or emergency vehicle driver. If you are caught breaking traffic law in any way while driving in Northeast, perhaps by driving over the legal speed limit, a police officer may pull you over and write you a traffic violation. As a CDL holder, a traffic violation issued to you may be a more pressing issue than it perhaps would be to a Class C motorist issued a citation for the same offense. This is because your career as a professional driver is dependent upon your clean driving record and responsible driving habits. In other words, if you plead guilty to your violation and points are subsequently added to your driving record, your means of living may be placed on the line. Instead of pleading guilty to your violation, it may therefore be in your better interest, and in the interest of your work, to challenge your violation instead. If Jack Byno & Associates is hired to help you challenge your Northeast CDL or trucking violation in court, our law firm may be able to seek you an acceptable plea deal in place of points added to your driving record. Please be advised, however, that some plea deals, including deferred adjudication, are not available to CDL holders.
If you have habitual Northeast traffic violations on your driving record, have been convicted of drunk driving or another serious traffic offense, or have been deemed medically unfit to drive by a doctor, your driver's license may be suspended by the Texas Department of Public Safety (Texas DPS). You will know in advance if DPS has decided to suspend your license, as a Notice of Suspension will be mailed to your address in Northeast. This DL suspension notice will inform you that you have 20 days to request a DL suspension hearing, at which to challenge the looming suspension of your driver's license, before your license is in fact suspended. Keep in mind that, in the case that DPS grants you a DL suspension hearing, the Law Office of Attorney Jack Byno may be retained to help you defend against your impending DL suspension in the Denton County Justice of the Peace Court. But let's say that your driver's license has already been suspended by DPS, perhaps because you have already lost a hearing that was granted to you. In this case, you may be interested in applying for a temporary driver's license commonly referred to as an Occupational DL, or Essential Need License. If you are granted an ODL, you may use it to drive yourself legally to work, school functions, and other locations essential to your daily life, until your regular license is no longer suspended.
